The OZERTY SVERIGE website is owned and operated by MOJO FZ LLC (hereinafter "OZERTY").

OZERTY attaches the utmost importance to respect for privacy and the protection of personal data and undertakes to take appropriate measures to ensure the protection of such data and to process and use it in accordance with the applicable provisions, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the General Data Protection Regulation, GDPR) and the Swedish Data Protection Act (dataskyddslagen).

ARTICLE 1: Data controller

Your data is collected by OZERTY (MOJO FZ LLC), with its registered office at A4-709 Building no. A4, Al Hamra Industrial Zone-FZ, 10055 Ras Al Khaimah, United Arab Emirates, registered under number 45000044.

Pursuant to Article 24 of the General Data Protection Regulation 2016/679 of 27 April 2016, OZERTY acts as the data controller for the processing of the data.

ARTICLE 2: Data collected, purposes and legal bases

OZERTY, in its capacity as data controller, may collect, consult, use, modify, store, transmit and delete personal data within the framework of its commercial and contractual activities.

In accordance with Article 4 of the General Data Protection Regulation 2016/679 of 27 April 2016, the terms "Data" or "Personal Data" refer to any information relating to an identified or identifiable natural person (hereinafter the "Data Subject").

An "identifiable natural person" is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to that person's physical, physiological, genetic, mental, economic, cultural or social identity.

OZERTY undertakes to collect personal data solely for specified, explicit and legitimate purposes and not to subsequently process such data in a manner incompatible with those purposes.

OZERTY undertakes to process only personal data which is adequate, relevant and not excessive in relation to the purposes for which it is collected.

This data is mostly collected directly from the data subjects when they:

  • Create a personal account on OZERTY's website.
  • Make a request to OZERTY.
  • Place an order on the website.
  • Browse the website and/or view the products.
  • Contact OZERTY's customer service.

Within the framework of the collection activities mentioned above, OZERTY collects the following data:

  • Identity data (first name, surname and, where applicable, gender, age, date of birth).
  • Contact data (email, postal address, telephone number, social network details).
  • Billing and payment data.
  • Details of the services and subscriptions taken out.
  • The history of the contractual relationship.
  • A copy of the individuals' correspondence with customer service.
  • Where applicable, responses to surveys and questionnaires as well as comments/reviews.
  • Technical information about browsing (e.g. IP address, browsing history, visit route, browser, operating system, information about the devices from which you visit the website, etc.).

Please note that certain items of this data, in particular gender, age or date of birth, are not collected systematically; they are collected only where applicable, when this is necessary for a specific purpose (for example for advertising measurement and optimization). OZERTY reserves the possibility of collecting them for this purpose in compliance with the principles set out in this policy.

In order to better understand the data processing carried out by OZERTY, we inform data subjects that OZERTY may process their data for the following purposes, each of which rests on a legal basis within the meaning of Article 6 of the GDPR:

  • Carrying out processing relating to administrative management (customer accounts, orders, deliveries, invoicing, debt collection). Legal basis: performance of the contract concluded with the data subject (Article 6.1.b) and compliance with legal obligations, in particular accounting and tax obligations (Article 6.1.c).
  • Carrying out processing relating to the management of the customer relationship (handling of reviews, satisfaction surveys, management of the loyalty program). Legal basis: performance of the contract (Article 6.1.b) and/or OZERTY's legitimate interest in improving its products and services and retaining its customers (Article 6.1.f).
  • Carrying out processing relating to the handling of complaints (after-sales service, handling of requests for access, rectification, objection, erasure, management of disputes). Legal basis: compliance with a legal obligation (Article 6.1.c) and OZERTY's legitimate interest in ensuring the defence of its rights (Article 6.1.f).
  • Carrying out processing relating to the management of marketing activity and improvement of the website (analysis of visitor numbers, customer targeting, commercial prospecting, etc.). Legal basis: the data subject's consent where required, in particular for the placement of certain cookies and the sending of electronic communications (Article 6.1.a), and/or OZERTY's legitimate interest in promoting and improving its services (Article 6.1.f).

ARTICLE 3: Hosting and transfer of Data

Personal data is hosted and processed within the European Union, as well as in countries recognized by the European Commission as ensuring an adequate level of data protection.

Where certain data has to be processed or accessed outside the European Union, such transfer is covered by the appropriate safeguards provided for in Chapter V of the GDPR, in particular the European Commission's standard contractual clauses, supplemented where necessary by additional measures intended to ensure an adequate level of data protection. ARTICLE 4: Recipients of the Data collected

Your data is intended for OZERTY. It may be disclosed to our providers acting in the capacity of data processors for the needs of the Service (in particular hosting of the website, payment processing, delivery of orders, sending of communications and audience measurement), who act solely on our instructions and are not authorized to use it for other purposes. Apart from these cases, OZERTY does not disclose your data to third parties.

ARTICLE 5: Data retention period

Data is retained for a period appropriate to the purposes of the processing and in accordance with the legislation and rules in force.

Data relating to the customer relationship is retained for the entire duration of the contractual relationship, and thereafter in an active database for up to three (3) years from the data subject's last contact or from the end of the contractual relationship.

At the end of this period, the data necessary to establish, exercise or defend legal claims may be archived, with restricted access, for the applicable limitation period. Accounting records and supporting documents (in particular invoices) are retained for seven (7) years from the end of the calendar year in which the financial year ended, in accordance with the Swedish Bookkeeping Act (bokföringslagen).

Data processed on the basis of consent (in particular for prospecting purposes or via certain cookies) is retained until consent is withdrawn, and at most for the periods indicated in Article 7 with regard to cookies.

ARTICLE 6: Your rights

In accordance with the General Data Protection Regulation 2016/679 of 27 April 2016 and the Swedish Data Protection Act, every person has the right of access, rectification, erasure and data portability with regard to their Personal Data, as well as the right to restriction of and objection to the processing of this data. Where the processing rests on consent, the data subject also has the right to withdraw their consent at any time, without this withdrawal affecting the lawfulness of the processing based on consent carried out before the withdrawal.

Individuals also have the right to lodge a complaint with the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten, IMY, www.imy.se).

ARTICLE 7: Cookie management policy

A cookie is a text file placed on your hard drive by the server of OZERTY's website. It usually contains the name of the server that placed it, an identifier in the form of a unique number and an expiration date. Its purpose is to collect information about your browsing in order to offer you services adapted to your terminal (computer, mobile or tablet).

On your first visit, a banner allows you to accept or refuse the placement of non-essential cookies. You may change your choices at any time via the settings provided for this purpose. Non-essential cookies are only placed after your consent has been obtained.

7.1 Functional cookies

7.3 Technical performance cookies

Technical performance cookies allow OZERTY to monitor the technical performance of its website, to detect problems in order to reduce inconvenience for the User as much as possible, to activate and support security features, but also to help detect malicious activity and violations of these terms.

The lifespan of technical performance cookies is limited to thirteen months.

Refusing the activation of such cookies or deleting them has no impact on people's browsing.

7.4 Audience measurement cookies

Audience measurement and statistics cookies allow the data controller to know the use and performance of the website, to establish statistics, visitor volumes and use of various elements (content visited, routes, etc.) with a view to improving the interest and ergonomics of the services offered (the most frequently visited pages or sections, the most read articles, etc.). These cookies are also used to measure consultation traffic on the website.

The lifespan of audience measurement cookies is limited to thirteen months.
